A grand jury is weighing an indictment of a millionaire widow for the murder of her husband on the Upper East Side 18 years ago, The Post has learned. Barbara Kogan, 64, who fled New York for Puerto Rico with $5 million from an insurance policy after the shooting of her husband, George Kogan, in 1990, has retained high-profile lawyer Barry Levin to defend her against charges she believes could hit her any day. Manuel Martinez, 57, Kogan's tax attorney, was sentenced last week to 25 years to life for hiring a hit man on her behalf to kill the wealthy businessman. The couple was in the throes of a bitter divorce when Kogan was shot three times in the chest by a gunman outside his mistress' East 69th Street apartment Oct. 23, 1990. Investigators immediatelysuspected his estranged wife after they found out she had called her husband's life insurance company only a week before the slaying to confirm she was a beneficiary on the policy. Kogan made the phone call to the insurance company, Levin said, because she was trying to get a copy of the policy for their divorce battle which the couple had been waging in court for two years. "George had taken all the paperwork from their home in Puerto Rico," Levin said. "She needed the policies because she wanted them to be part of the matrimonial settlement." Levin insisted that his client was innocent and said that DA's case was based on nothing but "innuendo and gossip. "I look forward to the trial and having my client vindicated so she can put 18 years of stress behind her," Levin said.
