State of New Jersey Revokes Robert Vivien's Corporate name

We have been informed by our attorneys that the state of New Jersey has notified Robert Vivien that approval of his corporate name, Newport Neighborhood Assn, was filed in error. According to the notification, the state's records indicate another corporation with the exact/similar name was previously reserved on February 23, 2007 for 120 days therefore making the name Vivien submitted unavailable. He must now select another name, and amend his corporate papers.
It is now official, Robert Vivien may not use the name of the Newport Neighborhood Association in any capacity. Copyright law also prohibits anyone from using the name on any advertisement, on T-shirts, literature or in any other manner without the permission of the legal owners.

We all know Robert Vivien's a liar, now the state of New Jersey has confirmed it. Consider this is a major defeat for Vivien, who must now remove the name Newport Neighborhood Association from every piece of paper, and paraphernalia.

enough with this, you've already made it known your hatred for this guy. and that you feel it is your responsibility to warn the few newport residents who frequent this board that you feel his primary goal in life is to bilk Jersey City residents. This is all common knowledge around these parts. So can we just let it go and discuss things a little more constructive around here? I get sick of reading the same negative stuff over and over and over and over again on this board. Surely you can't believe that this casts a positive light upon you as moderator of this board...

Ah Shaoilin! I have tried very hard over the years to get Sonia et al. to understand that point. So too have others (lenin etc.). But they insist on this going on and on and on and on and thereby cheapning any credibility the NWA has gained from its good work. It is a sad and bizzare psychological compulsion worth of case study. Now just wait a few minutes and Sonia will reply that they are required to publish all of this due to instructions from their lawyers and must warn the good people and other similar things! Enough said.

Okay, let's stop over dramatizing. The NWA's credibility is still solid, despite the Vivien attacks, but we do have a right to protect ourselves and our organization. Over a year ago this individual registered a corporate name similar to ours in order to confuse the community, and build credibility off of our good will. This past week, he got zapped by the state of New Jersey, and the corporate name he registered was revoked.
There's more, coming up very soon, but we have decided to post as it happens. Some of our members are very interested in how this matter progresses. Other visitors are concerned about their own liability, and wonder if their connection to Vivien could affect them, or their wallets. The only message board where they can learn the truth is here, and so, we will keep updating.

As you can see, Pluto's post has been deleted for unfairly and falsely criticizing the NWA. As for the contamination in the park, we have a lab report that clearly demonstrates the levels of both ecoli and Fecal cholorform bacteria, and the results were turned over to the Port Authority. Although we are still speaking with the PA, we can't predict what steps they will take.
In addition, we stopped passing out flyers, warning residents of the risk, not because of the planting, but at our lawyer's request, and because there is a legal matter pending, concerning the distribution of the flyers. Nevertheless, the risk of getting sick still exists.
It seems like you want things to happen at the snap of your fingers, but sometimes it takes a while to get the results we seek, especially when dealing with government agencies.
It took over a year for the state of New Jersey to rightfully, fairly and properly revoke Vivien's corporate name. Robert Vivien's actions were unprincipled, and presumably fraudulent because he knowingly tried to steal the corporate name of another organization. So, don't come on this board to criticize us because you're not happy with the results. Our lawyers are doing a great job, and we will see this matter through to its conclusion.
BTW, we understand the Lefrak management has informed Vivien, they are not supporting his projects. Nothing surprising about that, we all know Vivien never established a working relationship with management because of credibility issues. His situation is still the same.
Obviously, it is Vivien's whose credibility is damaged by New Jersey's finding, not the NWA. If anything, The NWA's credibility has been strengthened by this finding, which is completely in agreement with what we have maintained all along. The state's findings support our position 100%. Pluto used the wrong terminology. What we have accomplished is compelling, persuasive and formidable.

One last thing, in case anyone is questioning the State of New Jersey's letter, our lawyer has provided us with a copy, which is addressed to our corporation as well as Vivien. Yesterday, I showed the letter to Fermin Garcia, the General Manager for the buildings. He can confirm it's existence and content, if anyone is interested.

I don't think anyone is questioning what you post. I think the problem is most people have had enough with your ongoing battle/war/battleship fight with the evil empire or whatever they are called. I really don't care about the other group, and still wish you well on your litigation against them since I've seen you really help alot of people in our small community of Newport.

Thank you for your vote of confidence, and I agree we have been spending time that could be used to further the interests of the community, on fighting Vivien and his group.
The Newport Waterfront Association is the only active and recognized legitimate community association in Newport. Over the past nine (almost ten) years, we've done a tremendous amount of charitable work for this community, very often without any announcement or making a big deal out of it. Despite the lawsuit, we still have or are engaged in several issues that affect our community, and continue to meet 501(c)(3) requirements.
Our commitment to the community is still strong, and I assure you this association will continue in it's good works, even perhaps becoming a bit more vocal about it.
As far as the litigation is concerned, we've placed it in the hands of our lawyers, and are dealing with them. This board is not the battleground for the legal actions. I see no reason to announce every minor decision that takes place, and will keep my postings only to significant decisions that affect the association.
